Do you know who I am? I am a Sahrawi. The land to which I refer is what is known today as the non-self-governing territory ofWestern Sahara. My country was colonized by the Spanish and the French between 1884 and 1975, divided in two and occupied by Moroccan and Mauritanian forces thereafter, and has been ruled exclusively by the Kingdom of Morocco from 1979 until the present.

Los presos políticos saharauis de la cárcel de Salé, en huelga de hambre

Transcribimos a continuación la carta firmada por los presos políticos de la cárcel de Salé (Marruecos), tras el desmantelamiento del campamento Gdeim Izik, en la que denuncian las condiciones "insoportables y degradantes de la condición humana" que están soportando en la que informan que han decidido inicar una huelga de hambre de 48 horas para llamar la atención de la tragedia que soportan en reivindicación de sus derechos y llamar la atención del estado marroquí hasta lograr la liberación de todos los prisioneros políticos saharauis en  las cárceles de Marruecos.
Nosotros los abajo firmantes  militantes saharauis de los Derechos Humanos y prisioneros políticos saharauis en el contexto del desmantelamiento del campamento de Gdeim Izik y de las manifestaciones de Aaiún en el Sahara Occidental, y después  de nuestra transferencia por orden del  juez de instrucción de la corte Militar permanente Rabat en  Marruecos, prisioneros en la cárcel de Salé, estamos aislados en celdas individuales  de castigo , donde faltan las condiciones básicas de vida, sin ventilación, sin luz del sol. Todo el tiempo vivimos actos ilegales, en forma de violencia física (golpes), violencia psicológica (insultos, gritos, humillaciones), el acoso permanente.

Y estamos en estas condiciones insoportables y degradantes de la condición humana y aislados totalmente del mundo exterior, incomunicados, sin hablar de la provocación y del acoso y maltrato hacia nuestros familiares.

Frente a todo esto, y luego de agotar  todos los medios y frente a la posición hermética de la dirección penitenciaria quien ha cerrado todas las puertas del diálogo, si continúa sosteniendo esta política de marginación y de indiferencia hacia nuestras reivindicaciones, hemos decidido dar comienzo a una huelga de hambre 21 y 22 de febrero 2011, de 48 hs, como una primera etapa dentro de un plan de lucha, para lograr atraer la atención sobre nuestro sufrimiento y nuestra tragedia y la atención de nuestras reivindicaciones, que se traducen en una sola, nuestros derechos son:

  • La visita abierta de amigos y familiares, y en una sala especial de visitas.
  • Atención sanitaria, cuidados, servicio médico, sobre todo teniendo en cuenta que muchos de nosotros sufrimos enfermedades crónicas.
  • Alimentación nutritiva y balanceada.
  • Derecho a estudiar, a leer, a aprender.
  • Contacto con el mundo exterior (Libros, diarios, TV, radio, etc)
  • Libertad de correspondencia tanto la enviada como la recibida.
  • Recreos de tiempo suficientemente largos.
  • Derecho a comunicarse por teléfono con familiares y con el abogado defensor.
  • Y por último llamamos a todos los saharauis y a todas las personas de conciencia y a todas las fuerzas democráticas del mundo que defienden los Derechos Humanos a apoyarnos en esta lucha por nuestro derecho a la dignidad, y ayudarnos  a hacer presión sobre el estado marroquí hasta lograr la liberación de todos los prisioneros políticos saharauis en  las cárceles de Marruecos.

    El PNV pide a Jiménez "sensibilidad" con el pueblo saharaui que se opone al acuerdo de pesca entre Rabat y la UE


    MADRID, 22 Feb. (EUROPA PRESS) -
       El senador del PNV Iñaki Anasagasti ha pedido este martes a la ministra de Asuntos Exteriores y de Cooperación, Trinidad Jiménez, "un poco de sensibilidad" para con el pueblo saharaui, al que, ha denunciado, no escucha cuando defiende la prórroga del acuerdo de pesca con Marruecos que incluye las aguas del Sáhara Occidental.
       En la sesión de control al Ejecutivo en la Cámara Alta, el senador se ha preguntado si el Gobierno español se ha interesado en hablar con la población saharaui para conocer qué piensan de este acuerdo.
       En opinión de Anasagasti, el pueblo saharaui debería al menos estar "informado" de las negociaciones que entable la UE con Marruecos sobre el acuerdo de pesca que afecta a los recursos del Sáhara Occidental.
       La ministra se ha escudado en que tanto España como el Consejo de la UE reconocieron hace cuatro años que el actual acuerdo de pesca, que expira este mes de febrero, era "conforme con el derecho internacional y lo sigue siendo ahora" y que en 2000 el convenio fue ratificado por los parlamentos nacionales de los países europeos.
       No obstante, ha recordado, la Comisión Europea ha pedido a Rabat que entregue una evaluación sobre los beneficios que percibe la población del Sáhara Occidental.
       Para la ministra, la "sensibilidad" con el pueblo saharaui "no tiene nada que ver" con el acuerdo de pesca.
       Los ministros de Agricultura y Pesca de la Unión Europea aprobaron ayer negociar con Marruecos una prórroga de un año para el acuerdo pesquero que expira este domingo, 27 de febrero, en las condiciones actuales que incluyen las aguas del Sáhara Occidental pese a la oposición de su población.
       El objetivo es que la flota comunitaria no tenga que dejar el caladero marroquí mientras las partes negocian un nuevo convenio.

    Denmark promises to support Western Sahara


    Denmark has made positive promises that are meant to secure respect for human rights, access to natural resources and a legitimate process of self-determination in Western Sahara, Africa’s last colony.
    So let us for once take what a government, such as the Danish, says on human rights and democratisation at face value and forget about the grubby business of realpolitik that goes on behind the scenes. In other words, let us be positive and not cynical of what Denmark has to say on these matters, no matter how many times such pessimism has been proved right.
    Adopting such a positive frame of mind, there seems to have been something of a breakthrough in Denmark’s position on Western Sahara in recent months. From previously having mainly collaborated with Morocco on trade issues and giving empty public statements supporting Western Sahara, with notable examples such as a Ministry of Foreign Affairs statement from 2008, Denmark is now seemingly promising something that is concrete and can be judged against her future actions.
    Firstly, Denmark has clearly promised that she will not support a renewal of the EU-Moroccan Fisheries Partnership Agreement unless a new agreement benefits Western Sahara indigenous population, the Saharawis and is in accordance with international law.
    As Henrik Høegh, the Danish Minister for Food, Agriculture and Fisheries, stated in a documentary on Danish Radio in November, “if no proof is given on how the proceeds [from the Fisheries Partnership Agreement] have been used, my recommendation is that we vote against a new agreement. If we are to support this, it is important that international law is respected.” He has reiterated this promise in several answers to questions posed in the Danish parliament’s committee on food, agriculture and fisheries, most recently on January 12 where he said that “Denmark has continuously stressed the importance of the agreement benefitting the local population of Western Sahara to the Commission,” that “Denmark has stressed that we see it as essential that any potential new agreement must document that it is beneficial to the population of Western Sahara,” and that “Denmark will not be party to any agreement that is in breach of international law.”
    Ole Poulsen, Head of Section at the Minister for Food, Agriculture and Fisheries, who has advised the Danish government on the fisheries agreement, recently stated that Morocco has presented no proof of the fisheries agreement having any benefits for the Saharawis. This is so, even though the European Commission requested Morocco to present a report on the fisheries agreement’s impact on the local population of Western Sahara a year ago. “We haven’t had a concrete answer to how the agreement benefits the local population … it is very problematic,” he concluded when interviewed for a documentary on fisheries in Western Saharan shores on Danish radio. Mads Ovlisen, chairman of the Danish Government’s Council on Corporate Social Responsibility, agreed in asking rhetorically whether it can “in any way be ethically correct to pay an occupying power [Morocco] for natural resources from an occupied country [Western Sahara]?”
    Secondly, according to Danish Minister of Foreign Affairs, Lene Espersen, the issue of “human rights, and particularly freedom of assembly and press freedom, is an essential part of the ongoing bilateral dialogue between Denmark and Morocco.” Relations between the EU and Morocco are governed by the EU/Morocco Action Plan that speaks of a wish to “deepen … political, economic, social and cultural relations, as well as … security cooperation” between the two, and the EU-Morocco Association Agreement, that “emphasises the importance of the principles of the United Nations Charter, in particular the observance of human rights, democratic principles and economic freedom.” Lene Espersen insists that ”Morocco is obviously bound to respect its human rights obligations,”  and Denmark has been increasingly outspoken in criticizing Morocco’s human rights record in Western Sahara. Espersen recently said that she was “very concerned” about the recent developments in Western Sahara, specifically the brutal Moroccan clamp down on a protest camp near Aaiun (Laayoune), that the incident was “highly regrettable,” and that “Denmark will follow up on the situation of those still imprisoned,” and “support an international investigation” into the protest camp clamp down in answers given to the parliament’s committee on foreign affairs. The minister has therefore said that she would “like MINURSO [the UN’s peacekeeping mission in Western Sahara] to have the mandate to monitor the human rights situation” in the occupied territories in Western Sahara.
    And finally, Denmark is now unequivocally supporting a referendum on the status of Western Sahara. “Denmark supports the efforts of the UN in finding a mutually acceptable solution based on the principle of self-determination for the population of Western Sahara,” Minister of Foreign Affairs, Lene Espersen, said in an answer to the parliament’s committee on foreign affairs.
    Denmark has thus taken a leading role in assuring the self-determination, benefits from their resources and respect for the human rights of the Saharawi people. Along with the other Nordic Countries, Denmark is speaking out against the renewal of a Fisheries Partnership Agreement that clearly violates international law and for the respect for human rights in Western Sahara. One can only hope that Denmark will practice what it preaches and vote against this agreement in the European Commission and help ensure that human rights are respected though e.g. giving Minurso the mandate to monitor human rights in Western Sahara.
    All this is prudent in more than one way – especially if Denmark wants to continue using its development and foreign policies in an attempt to squander potential terrorism or defer the thousands of refugees on the doorstep of the EU in Northern Africa. Then perhaps promoting democracy is a better idea than propping up dictatorships such as Tunisia. As recent developments there have shown, dictatorships are no guarantee for stability or prosperity, quite the contrary. And as the president of the American Defence Forum Foundation, Suzanne Scholte, said recently, “Western Sahara has the greatest potential of any Arab country to become a pro-Western democracy.”
    If the Danish government believes that we have misunderstood their position on Western Sahara, however clear it seems to be, then it is most welcome to clarify it.
    BACKGROUND INFORMATION: Western Sahara has been illegally occupied by Morocco since 1975. As an occupying force, Morocco has no right to sell Western Sahara’s natural resources or violate the human rights of its citizens, but must instead work towards the a referendum on the status of Western Sahara. The Charter of the United Nations (article 3) clearly states that those nations who are “responsible” for non-self-governing states such as Western Sahara must ensure “ensure … their just treatment, and their protection against abuses,” “take due account of the political aspirations of the peoples,” “promote constructive measures of development,” and “transmit regularly to the Secretary-General for information purposes,” none of which Morocco can be said to be doing presently.
    The International Court of Justice rejected Morocco’s claim to Western Sahara when they occupied the country in 1975, and the illegality of Morocco’s presence in Western Sahara has been maintained by the UN Security Council and the UN General Assembly in over 100 resolutions. The USA, Britain and Denmark, and the rest of the “coalition of the willing,” on the other hand, invaded Iraq in 2003 under the pretext of Iraq not complying with UN resolutions.
    Regarding Western Sahara’s resources, former Under-Secretary General for Legal Affairs, Hans Correll’s UN Opinion from 2002 concluded that the selling of these resources was only legal if the population of Western Sahara agrees to and benefits from it, something a European Parliament Legal Opinion from 2009 and numerous statements from Sahrawi Arab Democratic Republic, Western Sahara’s government in exile, conclude they do not. The latter furthermore stated that “in the event that it could not be demonstrated that the FPA [Fisheries Partnership Agreement] was implemented in conformity with the principles of international law concerning the rights of the Saharawi people over their natural resource, principles which the Community is bound to respect, the Community should refrain from allowing vessels to fish in the waters off Western Sahara by requesting fishing licences only for fishing zones that are situated in the waters off Morocco.”
    Correll recently reiterated his point, in an interview with Swedish radio, saying that he believed that the European Commission had misinterpreted his opinion. Correll also restated his argument from the Legal Opinion in saying that “if the [fisheries] agreement is not signed with the interest of the people of Western Sahara, or after consultation with them, and the benefits do not go to the people of the territory, then it would be in violation of international law. I am afraid we have this situation in this case now.” The EU pays Morocco 36.1 million Euros annually to allow EU vessels to fish in its waters.
    The Human Rights situation in Western Sahara is also highly reprehensible, something that many Human Rights organisations have accounted for in numerous reports and other publications. Human Rights Watch speaks of Moroccan authorities acting with “impunity” and the ”evidence of torture and serious mistreatment ”against the indigenous population of Westerns Sahara, the Saharawis; International Crisis Group speaks of the Moroccan regime’s “disproportionate use of force” and it  “frequently resorting to torture and arbitrary arrests;” and Amnesty International speaks of Saharawis being “subjected to forms of torture and other cruel, inhuman or degrading treatment – including rape.”

    Morocco next? Protesters start organising

    Was it just yesterday that the Oread Daily cast a spotlight on the possibility of a popular uprising in Morocco? Well, boys and girls, hold onto your hats, it's a comin'.
    And remember in that very same article I speculated on what such might mean for the independence movement in the Western Sahara. Check out the last two paragraphs of the article below.
    And now we say to King Mohammed VI, it's time to be planning a career change.


    A growing number of Moroccan civil society groups are calling for large scale protest marches in the Kingdom. As the first protests are already being organised in Tangier and Rabat, the army is regrouping.

    Following the developments in Tunisia and Egypt, Moroccan youth groups have started organising the first protest marches in the country to demand political reform and greater human rights in Morocco.

    The first mass protests have already been organised in Morocco. On Sunday, the group ATTAC Morocco staged a larger demonstration in the northern city of Tangiers, with protesters focusing on "the deterioration of social conditions and high basic food prices."

    The Tangier protest however was brutally stopped by security forces, according to eyewitnesses. Batons and tear gas were used to disperse demonstrators who had gathered in the Square of Nations in central Tangier. Protesters had chanted slogans of solidarity with the people of Tunisia and Egypt, demanding a "right to employment, housing and a decent life."

    But Moroccan protesters have not given up, despite the brutal response by security forces. Today, there are reports from the capital, Rabat, about demonstrations in front of the Egyptian Embassy, with hundreds of protesters chanting slogans in solidarity of their counterparts in Egypt.

    Further protests are now being prepared by a magnitude of groups in Morocco.

    A group of young Moroccans is currently spreading the protest call through the social network Facebook, calling for demonstrations on 27 February "in front of the prefectures and the wilayas in all regions and central authorities in cities and villages, to demand the freedom of political organisation, the alternation of power and human rights."

    The so-called "Movement for Freedom and Democracy Now" in a statement specifies that this protest is "part of a spontaneous global transformation that aims at giving people their rightful place in society," further calling for democracy, freedom and the adherence to popular will.

    According to the statement, there is a list of demands including "the abolition of the current constitution, dissolve parliament and government, parties who have contributed to the consolidation of political corruption and take immediate real action for a political transition."

    The organisers further refer to "the terrible conditions of poverty, unemployment and human rights violations and restrictions on freedom of press" in Morocco. Morocco is known to be the poorest and least developed state in North Africa, facing enormous social problems.

    Also other organisations are calling for protests. A grouping of the political opposition, trade unions, human rights organisations and an association of the unemployed has issued a statement calling for rallies and demonstrations to be held next Saturday, 5 February.

    Also, the Labor Council of the Democratic Labour Confederation of Morocco has called for Sunday 6 February to be a day of protest. Marches are planned for in the south-eastern town of Ouarzazate "to protest the inhumane living conditions in Morocco."

    As the calls for protests are widening in Morocco, the regime is increasingly insecure. King Mohammed VI has met with French government officials and his most trusted military leaders in his private chateau outside Paris to discuss the security situation.

    Several unconfirmed reports from Morocco and occupied Western Sahara agree that security forces now are being pulled out from the occupied territory to be deployed in Morocco-proper in preparation of a possible popular revolt.

    The reported regrouping of Moroccan troops may leave Western Sahara - a territory whose indigenous Saharawi population is always ready to revolt - open to rebellion. Security forces stationed in Western Sahara are famed for great brutality against civilians, which could bode unwell for protesters trying to organise marches in Morocco.

    Human Rights Watch report: USA and France continue to support Morocco on Western Sahara




    “On Human Rights, the US continued to publicly praise Morocco’s reform efforts and advances made by women,” and “France rarely publicly criticized Morocco’s human rights practices and openly supported its autonomy planfor Western Sahara” says the new Human Rights Watch report. The report also points to the fact that France and the USA both provide Morocco with financial aid to back up their support.
    Both countries are permanent members of the UN Security Council, have a long history of ties to Morocco, and both press for Western Sahara to remain under Moroccan autonomy, not for the referendum on the status on Western Sahara that international law demands. “Genuine autonomy under Moroccan sovereignty [is] the only feasible solution,” stated a House of Representatives letter to President Barack Obama from April 2009. “I hope to see Morocco’s autonomy plan serve as the basis of negotiation in the search for a reasonable resolution. France will be at your side,” stated French president Sarchozy before Morocco’s parliament in 2007.
    France has had ties with Morocco as far back as the sixteenth century, went to war with Morocco on several occasions in an attempt to colonize Morocco, and eventually succeeded in colonizing part of Morocco from 1912 to 1956 (Spain colonizing the other part). France still sees Morocco as being part of its sphere of influence, the two governments have good political relations, and France is Morocco’s main trade partner and investor.
    Morocco was one of the USA’s closest allies in their fight against communism and is one of its main allies in its fight against terrorism. Morocco was the first country to recognize the independent United States, and the two nations also signed a treaty of friendship as long ago as in 1777 (renegotiated in 1836 and still in effect) that can be said to have laid the foundations of the two countries present good relationship. Amongst other things, this treaty states that “if either of the Parties shall be at War with any Nation whatever, the other Party shall not take a Commission from the Enemy nor fight under their Colors” and that “the Commerce with the United States shall be on the same footing as is the Commerce with Spain or as that with the most favored Nation.”

    How did Alouat get the chance
    to give the UN his perspective on
    the three-decade exile of his
    Saharawi people?
    “I requested to speak,” he said. “I was completely nervous! But the moment I started, I just got normal. I was speaking from personal experience, and what I was talking about was true.”
    He told the UN his people have a basic right to sovereignty — and “this right can come only when the United Nations passes a referendum allowing the indigenous people of Western Sahara the power to decide what they want: either to be an autonomous, self-governing country or a part of Morocco.”
    Alouat grew up in that refugee camp. His life changed when he won a UWC scholarship. He has taken the UWC spirit to Westminster — and he brought it to the UN, where he sat and talked for more than an hour with the ambassador of Morocco.
    “As a college student, I know you can listen to the other party. Whether you agree or not, you have to go listen,” Alouat said.
    Alouat speaks four languages and wants to become a PhD diplomat, to advocate for his people. “I am working very hard. We’ll see what is going to happen.”


    RFK Center calls for a thorough and impartial investigation on violent dismantling of Gdeim Izik camp

    Washington, February17, 2011(SPS) the Robert F. Kennedy Center for Justice & Human Rights (RFK Center) called for” a thorough and impartial investigation to seek truth, justice, during violent dismantling by Moroccan forces against Gdaim Izik camp on November 8,2010.

    “Based on the observations of the RFK Center delegation, it is clear that there has not been accountability for accusations of human rights violations resulting from the dismantlement of the Gdaim Izik camp and subsequent protests,” according to a report published Tuesday concluded visit of the delegation of the center to occupied city of El Aaiun from January 11 to 14, 2011.

    “The RFK Center again calls for a thorough and impartial investigation to seek truth, justice, and accountability for the victims of acts of violence or excessive use of force committed by state actors,”

    “The RFK Center focused on investigating alleged human rights violations committed by state actors. Due to recent unrest, the majority of our meetings addressed the violence committed on and after November 8, 2010, when the Gdaim Izik camp was dismantled.”

    “ During the course of the visit, the RFK Center delegation met with victims of torture and abuse, families of victims, human rights defenders, lawyers, representatives of the United Nations Mission for the Referendum in Western Sahara (MINURSO), and government officials,”

    “Although the delegation did not conduct in-depth investigations into personal accounts, consistent facts and evidence strongly indicate human rights violations were committed by state entities in violation of national and international law,”

    “Our findings, consistent with those highlighted in the Amnesty International report released in December 2010, entitled “Rights Trampled,” demonstrate the urgent need for a continuing, neutral, international presence to monitor the human rights situation,”

    “Human rights violations, including torture, disappearances, violations of due process, freedom of assembly, and freedom of movement, have been noted in Western Sahara.” the report indicated.

    During the dismantling of Gdaim Izik camp by Moroccan security forces On November 8th, the delegation confirmed that “ Violence and looting spread to the city of El Aaiun after this, fueled by frustration and anger about the ill-treatment of people, especially women, during the dismantling of the camp,”

    The delegation of RFK stressed that the “MINURSO staff explained that according to the status of forces agreement with Morocco, they should have freedom of movement without restrictions,” but “the MINURSO staff was denied access to the Gdaim Izik camp three times before November 8th.,”

    “They were granted access three days after the dismantling, on November 11, 2010, to examine the conditions.”

    “They indicated they were anticipating a confrontation before November 8thbecause, among other factors, they were asked by the local government to move their vehicles inside the UN compound.”

    The report confirmed through meeting with numerous of Saharawis that many cases of torture, Ill Treatment, Arbitrary Arrest, Excessive Use of Force and sexual assaults have been registered.

    “Numerous individuals reported excessive use of force or torture by Moroccan security or police to the RFK Center delegation. This often occurred when individuals posed no apparent threat to the security, “

    “The 31-year-old female arrested on December 28th also reported that the police sexually harassed her at the time of her arrest,”

    “Defense attorneys told the RFK Center delegation that male prisoners have been raped using bottles and batons.

    Human rights defenders from the Moroccan Association of Human Rights (AMDH) El Aaiun Section, a legally registered organization, reported that there are regular instances of this form of ill treatment during the investigation period. In particular, they stated that three men came to AMDH indicating that they were raped with glass bottles at the brigade gendarmerie and prison.”

    The delegation of Robert Kennedy center for justice and Human rights recommended that “the situation in Western Sahara requires constant neutral, international monitoring with a mechanism to ensure accountability by state actors,”

    في أم الدنيا ظل زملاء ورفقاء حسني مبارك وحاشيته والموالون له يغردون خارج سرب الحقيقة التي أكدتها من قبل الجماهير التونسية حين أرسلت برقية على جناح السرعة للحكام الذين لا ينظرون للشعوب إلا نظرة دونية ملؤها الاستكبار والاستحمار والاستهتار والاحتقار ، مفاد الرسالة أن الظلم عاقبته وخيمة ، وأن العدل لا يمكن أن يأتي إلا بخير ، وأن زمن الخوف من السياط المرفوعة والجدران التي لها آذن تسمع وأعين ترى وأفواه تتكلم بالزور أمام الحاكم قد ولت بدون رجعة رجعية ، وأن الخوف من خفافيش الظلام وصانعي كل نظام قد يتحول مع جرعات الضغوطات الممارسة على الشعب إلى شجاعة تجعل من التقهقر والتأخر عن النزول إلى الشوارع والمطالبة بإسقاط النظام بدعة شنيعة لا يجوز اقترافها أو الاقتراب منها ، هذه الحقيقة هي التي أزاحت بنعلي عن كرسي السلطة ، وفاجأت حاكم مصر مباشرة بعد تصريح المسؤولين عن أم الدنيا بأن أمهم العزيزة بخير وعلى خير وأن " تونسة " مصر تعد من سابع المستحيلات ، وأن من ينادي ب" التونسة " ماهو إلا فتان خائن عميل للخارج ملعون بنص الشرع والعرف والقانون ، فجاءت الردود سريعة من ميادين التحرير المصرية  تؤكد بصوت واحد أن " الشعب يريد إسقاط النظام " قبل أن يتحول هذا الصوت بعد نسيان النعرات الطائفية والاختلافات الإديولوجية وتحت تأثير " بلطجية " النظام إلى أن " الشعب يريد إعدام الرئيس "، وسواء في أم الدنيا أو في تونس الخضراء تبين للعالم أجمع كيف يتعامل النظام الدكتاتوري مع المطالب الشعبية والمظاهرات السلمية ، فالزعيم يخرج بعد صمت طويل في خطاب طويل يتوعد ويهدد ويعربد ظنا منه أن العربدة الخطابية قد تنال من عزيمة الشعب ، بعدها ولأنه أثار في خطابه حفيظة كل محتج ومتظاهر يحرر بنفسه أو بالإستعانة بخبراء دوليين خطابا لينا يحاول أن يصلح به ما أفسدته كلمات الخطاب الأول فيبدي تفهمه لمطالب الشعب ويلقي باللائمة عللى أعوانه ومستشاريه ويعلن عن نيته الابتعاد عن الحكم ولكن بعد مدة زمنية يحددها مسبقا أو ينساها عمدا ، وحين لا تنفع هذه الخطة يستنجد الزعيم بحرسه الخاص وبجهاز قمعي جديد مكون من قطاع طرق ولصوص ومفسدين ومفسدات يزهقون ما لا يعد ولا يحصى من الأرواح ويثيرون البلبلة والفوضى في صفوف الشعب المحتج حتى يبعث له رسالة مضادة مفادها أنه هو حامي البلاد والعباد وبدونه على الأمن السلام ، ثم بعد ذلك تأتي سياسة إحراق البلد بما فيه والفرار تحت جنح الظلام إلى مكة المكرمة بعد رحلة إجبارية طويلة في عرض السماء الدنيا ومن تم العزلة الأبدية و " الفقسة " القلبية  .  
    وفي المغرب بلد إمارة المؤمنين ، وبلاد الملكية التاريخية ، لا زال بعض من يعشقون الصيد في الماء العكر يرددون على مسامعنا آناء كل ليل وأطراف كل نهار أن هذا البلد لن يشكل إلا الاستثناء ، فلا انتفاضة قد يعرفها ولا خوف عليه ولا أهله سيحزنون ، ولكي يضفوا على تمويهاتهم المفضوحة شرعية تحترم استنجدوا بترسانة إعلامية تنتمي لسلالة الرصيف تسابقت فيما بينها على التقاط تصريحات لمسؤولي منظمات حقوقية وهيآت نقابية ومؤسسات إعلامية أجنبية ـ كانت جلها إلى عهد قريب غير مرغوب فيها وفي تقاريرها ـ يؤكدون على أن المغرب ينعم باستقرار دافئ وأمن لا مثيل له بحكم ملكيته العريقة وثقافته الشعبية المرتبطة بشخص الملك إلى أبعد الحدود ، ولكي يزيدوا من حدة شرعية ضحكهم على الذقون دعوا من غير تأمل في العواقب إلى " مسيرة حب " باءت بالفشل ، وجندوا  لهذا الغرض جيشا " افتراضيا " أخرج من دهاليز النسيان مقدسات قديمة وخطوطا حمراء وأشهرها في وجه كل من له رأي مخالف في هذا الأمر ، فخونوا جيلا من الشباب المثقف الداعي إلى التغيير ورموا من غير بينة كل من نادى بملكية برلمانية أو ناشد الملك محمد السادس بالقيام بإصلاحات جذرية تستجيب لتطلعات الشعب ومطالبه ، رموه بالتعامل مع المخابرات الجزائرية وألصقوا به تهمة الإنفصال والتآمر على الوطن وانسلوا إلى مصالحهم متوهمين أن تمويهات بهذا الشكل ومن هذا النوع قد تحول دون تأثر الشعب المغربي بما يقع في بلدان ذاقت شعوبها ما يذوقه الشعب المغربي كل يوم فنزلت إلى الشارع  بإصرار نادر تطالب بحقها في كل شيء .
    إن المقدسات التي أشهرها اليوم ملكيون أكثر من الملك إنما صنعت خصيصا لإخفاء جبال الجليد التي يتزلج عليها كل مسؤول مات ضميره وارتقى في سلم المسؤولية مستغلا ما تقدمه له الحصانة الممنوحة من منح ليصنع مملكة خاصة به وليعيث في المملكة المشتركة فسادا وإفسادا ، فبت ترى العجب العجيب العجاب وتسمع عن المستحيل في بلاد الأدارسة والمرابطين والموحدين والشرفاء التابعين لهم بإحسان ، وبت تقرأ عن دويلات داخل الدولة الأم ، فهذه دولة الجنرال ، وتلك دولة الوزير ، وهؤلاء أتباع الوالي ، وأولئك أنصار العامل ، ولكل دولة ميزانياتها الخاصة ، ولكل تابع نصيبه الثقيل مقابل تبعيته العمياء ، والخزينة طبعا جيوب شعب لا دولة له ولا حق له في التحسر على ما مضى أو التدخل في ما يجري ، أو التساؤل عما سيحدث لبلد حاله أبأس حال ، فالفقر أرقامه تتعالى ، والأمية تطغى على أكثر من ثلثي المجتمع ، والنمو الاقتصادي في تقدم مثير نحو الوراء ، والأمن يبحث عن أمن في ظل الارتفاع الصاروخي لمعدل الجريمة ، والبطالة تدق ناقوس خطر الخطر ، والجرف الهار يكاد ينهار ، والمقدسات  تسيطر على الوضع بأكمله ، والخوف كل الخوف من أن يغتر حماة المقدسات بما لهم من عتاد وجنود ويفكرون بمنطق الأنا الأعلى ويغلبون بذلك المصالح الذاتية والمآرب الشخصية على مصلحة الوطن والمواطنين .
    مصر أم الدنيا تصنع في هذه الأيام انتقالها التاريخي من قبضة الاستبداد إلى عوالم الديمقراطية النزيهة الشفافة ، وقد آن الأوان لأن يكون المغرب أبا للدنيا في هذا المجال ، ولن يتأتى له ذلك إلا إذا قطعت السلطات في هذا الوطن الحبيب حبل الود بينها وبين ما للاستبداد السياسي والاقتصادي والاجتماعي والقضائي والثقافي من معان وأشكال وتجليات ، وجلست جنبا إلى جنب مع كافة أطراف وحساسيات المجتمع من غير استثناء لتوفير حلول حقيقية جذرية وسريعة لمختلف الأزمات التي يتخبط فيها مغرب 2011 ، أما الرهان على أنشطة مخابرات الفايسبوك وتويتر وباقي مواقع التواصل الاجتماعية ، وتقارير مخابرات الوقفات والحلقيات ، وملاحقة المناضلين والمناضلات هنا وهناك والاستخفاف بقدرات الشعب المغربي شيبا وشبابا ذكورا وإناثا فلن يعجل إلا بانتفاضات لا يعلم إنس ولا جن كيف ستبدأ وبم ستنتهي .
    فهل سيكون المغرب أبا للدنيا في مجال التغيير السلمي ؟؟؟
    هذا ما أتمناه من أعماق أعماق قلبي .

    استخدمت شرطة مكافحة الشغب المغربية القوة لتفريق مظاهرة ضخمة دعت إليها “جمعية أطاك المغرب” للإحتجاج على تردي الأوضاع الإجتماعية في المغرب و ارتفاع أسعار المواد الغذائية و الخدمات الأساسية.
    و تقول معلومات الدولية إن قوات مكافحة الشغب استخدمت العصي و القنابل المسيلة للدموع لتفريق المتظاهرين في ساحة الأمم وسط مدينة طنجة أقصى شمال المملكة المغربية.
    و كانت تسير في التظاهرة الإحتجاجية التي خصصت أيضا للتضامن مع الشعبين التونسي و المصري حشود كبيرة قدرتها مصادر الدولية بالمئات،
    و ردد المحتجون  شعارات غاضبة ضد الحكومة المغربية مطالبين بإقالتها فورا،كما رفعوا شعارات تطالب بما أسموه حقهم في السكن و الشغل و حياة اجتماعية كريمة،كما رفعت شعارات منددة بالسياسة الحكومية،مطالبين برحيل “الحكومة الفاسية” على حد تعبيرهم.

    وانتصرت إرادة شعب بلاد الكنانة، وأرغم الفرعون على "فهم" معنى "إرادة الشعب"، ومعنى إصرار المقاومة السلمية في التحدي، وفي فرض هذه الإرادة، ولم تنجح كل خطط التشتيت، والشرذمة، ولا العنف والقمع والتقتيل، ولا استعمال "البلطجة" والإجرام في ثني عزيمة شعب أراد الحياة وفرض شق طريقه إليها بشكل حضاري وسلمي أبهر العالم.

    ولا يسعنا هنا إلا أن نحتفل مع الفلاح المصري البسيط، ومع المثقف، ومع الشباب المكافح والثائر، والواعي، الذي فرض خياراته وخيارات مصر المستقبل دون أن يسقط في فخاخ العنف التي حاول نظام "الفرعون المخلوع" دفعه إليها.

    وبالقطع، فقد تغيرت جيوستراتيجية المنطقة بأكملها، فمصر بثقلها العربي، الإفريقي، الإسلامي لا يمكن تجاهل دورها الجديد بعد الآن، ولا يمكن التنبأ التام بالإتجاه الذي ستتجه إليه دفتها بعد أن تنتهي فرحة النصر الشعبي لتبدأ معاول بناء نظام جديد يستمد شرعيته هذه المرة من ثورة "شباب"، وثورة "الفيس بوك"، وثورة المستقبل.

    والآن، يمكن القول أن كل عواصم العالم الغربي تقف مشدوهة أمام الحدث، الذي لم يجد باراك أوباما أمامه سوى الإنحناء بعد أن أعياه فهم ما حصل، وكيف حصل في غفلة من أجهزة المخابرات الأمريكية، ليقول بأن "التاريخ تشكل في مصر، وأن الشعب قال كلمته"، وهو على حق.

    ويمكن القول أن خريطة المواقف السياسية بالشرق الأوسط وبشمال إفريقيا ستعرف إعادة حتمية للحسابات، وستكون لها تأثيرات عميقة وطويلة الأمد، فإسرائيل ترتعد الآن، والسلطة الفلسطينية ترتعد بدورها، وكل الأنظمة العربية تتوجس خوفا من "عدوى الثورة"، ويكفي معرفة أن ملك البحرين، حسب رويترز، قد بادر إلى توزيع ألف دينار على كل عائلة، فهل هناك حاجة لمزيد من الإيضاح.

    ويبقى أن القوى الغربية، وخصوصا الولايات المتحدة الأمريكية، وأوروبا، لن تدع هذه الثورة المصرية التاريخية وشأنها، وستحاول بكل الطرق المعروفة لاستعادة السيطرة على النظام القادم، الذي يضمنه الجيش المصري الآن. لكننا لا يجب أن ننسى بأنه نفس الجيش الذي تعايش مع اتفاق كامب ديفيد، ومع النظام المصري منذ السادات دون أن يعترض يوما على موقف مصر المخزي من عدد من القضايا العربية والدولية طيلة عقود.

    فهل ينجح الشباب المصري في تغيير الموقف لصالح إرادة الشعب العربي، المسلم والإفريقي؟ أم هل سينجح النظام الجديد، والذي سيكون حتما نتيجة لتوافق وتصارع القوى السياسية المصرية الجديدة ومصالح قوى دولية، في الحفاظ على "نظام" متوازن وإمساك العصى من الوسط بين تطلعات الشعب في الديمقراطية والحرية وإكراهات الموقع الجيوستراتيجي والتاريخي لمصر في موازين القوى في الشرق الأوسط وشمال إفريقيا؟ أم هل تنجح القوى المجروحة الآن في مصادرة الثورة من صناعها بتواطئ من أنظمة عربية ودولية مطعونة؟ هذه أسئلة وغيرها كثير ستجيب عنها تطورات الأيام القادمة، ونرجو أن تكون في النهاية في صالح الشعب المصري وبحجم تضحياته.

    ولنا أن نقول فقط : المجد والخلود لشهداء ثورة الشعب المصري العظيم، وهنيئا لنا جميعا في العالم العربي، والإفريقي والإسلامي والعالمي بهذا النصر الشعبي التاريخي و"عمار يا مصر"

    قالت هيومن رايتس ووتش اليوم، إن دورية الحكومة التي حررت سياسة المغرب المرتبطة بالاعتراف بالأسماء الأمازيغية، أو البربرية، التي أطلقت على حديثي الولادة، لها نتائج إيجابية.

    أصدرت وزارة الداخلية دورية، في أبريل/نيسان 2010، تُعرف لأول مرة الأسماء الأمازيغية على أنها تلبي الشرط القانوني المتعلق بـ "الطابع المغربي". وقال العديد من نشطاء حقوق الأمازيغ لـ هيومن رايتس ووتش إنه خلال ثمانية أشهر بعد ذلك، اشتكى عدد أقل من المواطنين ضد المكاتب المحلية للحالة المدنية التي رفضت تسجيل أسماء أمازيغية معينة. وقالت هيومن رايتس ووتش، إن الشرط العام على أن تكتسي الأسماء التي يختارها الآباء يجب أن تكون "مغربية الطابع"، لا يزال يحد من خيارات الوالدين ويخلق عراقيل إدارية، وينبغي تخفيفه.

    وقالت سارة ليا ويتسن، المديرة التنفيذية لقسم الشرق الأوسط وشمال أفريقيا في هيومن رايتس ووتش: "باعترافها صراحة بالأسماء الأمازيغية على أنها مغربية، تكون الحكومة قد خففت من القيود المضرة بحق الوالدين في اختيار أسماء أبنائهم. وتظهر هذه الخطوة المزيد من الاحترام والاعتر بالتنوع العرقي والثقافي لسكان المغرب".

    وقد تزايد تمسك بعض السكان الأمازيغ في المغرب بالمطالبة بالاعتراف الرسمي بثقافتهم واللغة الأمازيغية خلال السنوات الأخيرة. وردت الدولة المغربية من خلال إنشاء المعهد الملكي للثقافة الأمازيغية في عام 2001 وأطلقت برامج في تلفزيون الدولة وتعليم اللغة الأمازيغية في المدرسة الابتدائية.

    ورغم ذلك، فإن رفض مكتب الحالة المدنية تسجيل العديد من المواليد الجدد الذين أطلق عليهم آباءهم أسماءً أمازيغية، لا يزال نقطة حساسة بالنسبة للنشطاء الأمازيغيين. وكان هذا كله صحيحا بما أن الأسباب الظاهرية للرفض هي أن هذه الأسماء ليست "مغربية"، وعلى النقيض من ذلك يتم قبول الأسماء العربية الإسلامية، على الرغم من أن الأمازيغ هم السكان الأصليون للبلاد، بينما العرب هاجروا إلى هناك منذ قرون.

    وبينما تؤكد الدورية من جديد أن مكتب الحالة المدنية قد يقبل فقط الأسماء التي هي "مغربية الطابع"، فإنه يوجه ضباط الحالة المدنية إلى اعتماد " الإرشاد والإقناع، والحوار مع المصرح واستعمال المرونة مع المواطن"، و "والبحث والتحري والاستئناس بالقرارات الصادرة عن اللجنة العلیا، والجھاز القضائي قبل رفض الاسم".

    وتبت اللجنة العليا، والتي تتكون من المؤرخ الرسمي للمملكة وممثلين عن وزارتي العدل والداخلية، في مشروعية الأسماء التي يرفض أو يتردد مكتب الحالة المدنية في قبولها. على سبيل المثال، تبين لائحة بالأسماء التي أصدرتها اللجنة في جلستها المنعقدة بتاريخ 24 يونيو/حزيران 2005 أن الاسم الأمازيغي "سيفاو" من بين الأسماء التي رفضتها والاسم الأمازيغي "ميرا" من بين تلك التي قبلتها.

    دورية أبريل/نيسان 2010

    أرسلت وزارة الداخلية دوريتها D-3220، المؤرخة في 9 أبريل/نيسان، إلى ولاة الجھات وعمال العمالات والأقالیم وعمالات المقاطعات، وكلها تحتضن مكاتب الحالة المدنية، حيث يسجل المواطنون المواليد والوفيات والزيجات.

    وتُفسر الدورية D-3220 القانون الذي يحكم اختيار وتسجيل الأسماء، قانون 37-99 المتعلق بالحالة المدينة، الذي اعتمد في 3 أكتوبر/تشرين الأول 2002. وتشترط المادة 21 من هذا القانون أن يكتسي الاسم المختار "طابعا مغربيا وألا يكون اسما عائليا أو اسما مركبا من أكثر من اسمين أو اسم مدينة أو قرية أو قبيلة وألا يكون من شأنه أن يمس بالأخلاق أو النظام العام".

    وتُشير الدوريةD-3220 إلى "حریة المواطن في اختیار الاسم الشخصي لمولوده"، والحاجة إلى منع انتهاكات هذا الحق و "وتفادي أي نزاع قد یحدث في ھذا الشأن بین ضباط الحالة المدنیة والمواطنین".

    وتقدم الدورية تفاصيل عن الإجراءات التي ينبغي أن يتبعها مكتب الحالة المدنية عندما يواجه اسما غير مألوف. كما أنها تقدم علنا ولأول مرة تعريفا رسميا من جزئين لـ "المغربي" من حيث صلته بالأسماء المختارة. الجزء الأول من التعريف يقول:

    والمقصود بعبارة

    "الطابع المغربي" خصوصیات المجتمع المغربي من شماله إلى جنوبه ومن شرقه إلى غربه، وأن یكون الاسم الشخصي متداولا بالمغرب، إلى درجة جعلته متواترا، أي جرت العادة على حمله، فلا یعتبر غریبا على الأذن المغربیة، ولا على الوسط المغربي بجمیع مكوناته. فھو اسم شاع حمله، ولا توجد أدنى مشقة أو صعوبة في التعرف عليه.



    ويقول الجزء الثاني إن الأسماء المختارة يجب أن تأتي أيضا من واحدة من الفئات الخمس التالية:

    1-ا الأسماء العربیة المتداولة منذ القدم بالمغرب؛

    2- أسماء الله الحسنى متى سبقت بلفظة -عبد- وجردت من أداة التعریف "ال"؛

    3- الأسماء الأمازیغیة، والتي قد یختلف معناھا من منطقة إلى أخرى؛

    4- الأسماء التي أصبحت متداولة بالمغرب في السنوات الأخیرة، ذات نطق عربي سلیم أو ذات أصل إسلامي؛

    5- الأسماء العبریة بالنسبة للیھود المغاربة.

    وتحيل الدورية أيضا على لوائح موجودة بالأسماء، وكثير منها أمازيغي الأصل، والتي وافقت عليها أو رفضتها اللجنة العليا للحالة المدنية قبل صدور قانون 37-99. وتنص الدورية على أنه يمكن لمكتب الحالة المدنية أن يطلع على تلك اللوائح، المرفقة بالأسماء "المقبولة" و"المرفوضة"، إلا أن هذه القرارات ليست ملزمة قانونا.

    استمرار المقاومة الإدارية: دراسة حالات

    لا توجد إحصاءات متاحة للعموم على وتيرة منع السلطات المغربية الوالدين من تسجيل اسم معين من اختيارهم. ورغم ذلك، فإن الأدلة الواقعية التي تم جمعها من طرف الناشطين في مجال حقوق الأمازيغ في المغرب تُشير إلى أن العراقيل الإدراية أمام تسجيل الأسماء الأمازيغية كانت أكثرترددا قبل صدور الدورية D-3220. وحتى قبل أن تُصدر وزارة الداخلية الدورية، وافقت مكاتب الحالة المدنية على بعض الأسماء الأمازيغية، إما فورا أو بعد حملة الآباء ضد الرفض الأولي أو طعنهم فيه.

    ووثقت هيومن رايتس ووتش رفض الأسماء الأمازيغية في رسالة بعثت بها إلى وزارة الداخلية في 16 يونيو/حزيران 2009، والتي لم تقم الحكومة بالرد عليها.

    ولا تقتصر المخاطر المحيطة بتسجيل اسم على التعبير الشخصي أو الثقافي. عندما يرفض مكتب الحالة المدنية تسجيل رضيع بسبب الاعتراض على اسم معين له أو لها، فإن الرضيع يظل دون وضع قانوني. ويمكن أن تعترض الوالدين عقبات في الحصول على الخدمات العمومية، مثلا عند التقدم بطلب الحصول على جواز سفر للطفل أو السعي للحصول على تعويضات عن مصاريف التطبيب من التأمين الصحي الرسمي. وقال العديد من النشطاء الأمازيغ لـ هيومن رايتس ووتش، إن بعض الآباء سجلوا اسما عربيا إسلاميا بدلا من الاسم الأمازيغي الذي قد يختاروه خلاف ذلك، لتجنب مثل هذه المشاكل والصراعات مع الإدارة.

    ففي حين تضمنت الدورية 3220 D- أسماء أمازيغية بين تلك التي قد تعتبر ذات "طابع مغربي" ووجهت ضباط الحالة المدنية نحو التفاعل البناء مع الآباء، إلا أنها تُحافظ على عدد من القيود على حق المغاربة في اختيار أسماء لأطفالهم. إنهم ما يزالون يواجهون الرفض إذا كان الاسم الأمازيغي المختار غير مألوف بالنسبة لموظف مكتب الحالة المدنية المحلي، أو أنه يرى أنه صعب النطق أو غير مألوف بشكل كاف. وقد حدث هذا، على سبيل المثال، عندما يكون اسم غير شائع في منطقة واحدة ولكنه أكثر شيوعا في مناطق أخرى.

    وكما يتضح من عدد من الحالات الأخيرة التي تم وصفها لـ هيومن رايتس ووتش، فإن المسؤولين على المستوى المحلي يستمرون في الطعن في بعض الأسماء الأمازيغية. وفي حين يبدو أن الآباء الذين أصروا قد نجحوا في معظم الحالات، لا تزال المسطرة مرهقة وتشكل عبئا على الأسر التي، لممارسة حق أساسي في تسمية أطفالها، تجد نفسها مدعوة إلى جمع وتقديم وثائق إضافية، والقيام بزيارات إضافية إلى الإدارة، وحشد دعم المنظمات غير الحكومية أو الشروع في دعوى قضائية أو حملة إعلامية.

    يوبا (أكادير). في يوم 21 أكتوبر/تشرين الأول، حاول محمد الويحيوي وزوجته رقية بوقرن، تسجيل اسم "يوبا" لابنهما، الذي ازداد (وُلد) في 9 أكتوبر/تشرين الأول، في مكتب الحالة المدنية في حي الهدى في مدينة أكادير الجنوبية. وقال الويحيوي إن الموظف المداوم رفض على أساس أنه لم يكن اسما مسموحا به. وعاد الويحيوي أكثر من مرة خلال فترة 30 يوماالقانونية لتسجيل المولود الجديد . وعلى الرغم من أنه أثار الدورية 3220D ، وأوضح أن يوبا هو اسم لملك أمازيغي قديم، إلا أن الموظف أصر على رفض تسجيل الطفل تحت هذا الاسم. وقد بدأ الوالدان الإجراءات القضائية اللازمة لتسجيل اسم المولود الجديد بعد انقضاء فترة 30 يوما. وقال والده لـ هيومن رايتس ووتش، إنه حتىإلى يوم 8 ديسمبر/كانون الأول، كان يوبا ما زال غير مسجل.

    سيمان (سيدي سليمان). أنجبت السيدة عزيزة بولويحة، وهي من مدينة سيدي سليمان شمال شرقي الرباط، فتاة بتاريخ 12 نوفمبر/تشرين الثاني. ثلاثة أيام بعد ذلك، زار زوجها، صالح مارزو، مكتب الحالة المدنية بالمقاطعة الأولى في المدينة، للاستفسار إذا كان بإمكانه تسجيل المولود تحت الاسم الأمازيغي سيمان، الذي يعني "روحين". وقال صالح لـ هيومن رايتس ووتش إن الموظف قال لا بما أن سيمان لا يظهر على اللائحة التي كان قد راجعها. وقال الأب إنه قدم الدورية D-3220 رفقة وثائق تبين الحالات السابقة التي تمت فيها الموافقة على سيمان. وفي يوم 22 نوفمبر/تشرين الثاني، ذهبت زوجته لتسجيل الاسم، ولكن ضابط الحالة المدينة رفض مرة أخرى، موضحا أن سيمان ليس اسما شائعا بما فيه الكفاية. فاقترح الموظف عوض ذلك اسم "إيمان"، إلا أن الوالدين رفضا. وطلب صالح من منظمة أمازيغية الاتصال بالإدارة. وحسب صالح، فى أواخر نوفمبر/تشرين الثاني، وافق مكتب الحالة المدنية على تسجيل سيمان، إلا أنه ألزمه بتوقيع تصريح بأنه يتحمل كافة العواقب القانونية لاختيار هذا الاسم.

    مازيليا (ليل، فرنسا). رفضت القنصلية المغربية في ليل، شمال فرنسا، في يوليو/تموز 2010، السماح للمهاجر المغربي، الحسين أزركي من روبيكس، وزوجته، عبدة الكسري، وهي مواطنة فرنسية، بتسجيل اسم "مازيليا تارا" لابنتهما التي (وُلدت) في 10 ديسمبر/كانون الأول 2009. بعد فترة وجيزة من (ولادة) الطفلة، سجلها أزركي لدى مكتب الحالة المدنية الفرنسي. وقبل المسؤول في القنصلية المغربية "تارا"، وهو اسم أمازيغي رفضته القنصلية نفسها في عام 2006 ولكنها قبلته في وقت لاحق بعد ما قدم والدي تارا وثيقة مغربية بتسجيل فتاة أخرى تدعى "تارا". ولكن المسؤول قال إن "مازيليا" يظهر على أنه "مرفوض" في قائمة الأسماء التي راجعها.

    مازيليا هو واحد من 11 اسما وضعت عليهم علامة "مرفوض" في قائمة من 40 اسما مختارا بتت فيها اللجنة العليا للحالة المدنية خلال جلسة يوم 5 يوليو/تموز 2006. هذه القائمة هي من بين تلك التي عممتها وزارة الداخلية على مكاتب الحالة المدنية.

    وقال أزرقي لـ هيومن رايتس ووتش إنه كتب رسالة احتجاج إلى السلطات المغربية لكنه لم يتلق ردا، ولم يحاول مرة أخرى تسجيل ابنته. وواجه أزركي والكسري مشكلة مشابهة عندما حاولا تسجيل ابنتهما الأكبر، نوميديا تين آس، في 6 مارس/آذار 2007، في القنصلية في ليل. وقبل الموظف المداوم، بعد ما اطلع على القائمة بحضور أزرقي، "نوميديا" ولكنه رفض "تين آس"، واعدا قبول هذا الأخير إذا استطاع أزرقي أن يوفر شهادة ميلاد طفلة مغربية أخرى تحمل هذا الاسم. وفي ديسمبر/كانون الأول من ذلك العام، تلقى أزركي وزوجته رسالة من القنصلية المغربية تدعوهما إلى تسجيل ابنتهما تحت الاسم الكامل الذي اختاراه.

    ومازيليا هو اسم لعائلة ملكية أمازيغية قديمة.

    سيمان (القنيطرة). ذهب الصديق رفيعي من القنيطرة، شمال شرقي مدينة الرباط، إلى المكتب المحلي للحالة المدينة، أسبوعين بعد ولادة ابنته في 4 أبريل/نيسان. ورفض الموظف المداوم الاسم ونصح الصديق وزوجته، هند جبري، باختيار اسم أكثر شيوعا. وقال الصديق لـ هيومن رايتس ووتش إن سيمان أكثر شيوعا في منطقة سوس في جنوب المغرب منه في المنطقة الشمالية، حيث يقيم حاليا. في وقت لاحق من اليوم نفسه، عاد الصديق إلى مكتب الحالة المدنية، و قدم نسخة من الدورية 3220 D وشرح معنى "سيمان" (روحين). في هذه المرة، سجل الموظف الاسم.

    ماسيليا (تمارة). ذهب جمال إدغور، بعد أسبوع واحد من ازدياد (ولادة) ابنته في 3 نوفمبر/تشرين الثاني، إلى مكتب الحالة المدنية في تمارة، إحدى ضواحي الرباط، لتسجيلها تحتاسم "ماسيليا"، الاسم الذي اختاره لها هو ووزوجته سميرة هيري. ويعني هذا الاسم الأمازيغي القديم وغير المألوف "إلهة البحر". ورد الموظف المداوم أنه لا يعرف إن كان الاسم مقبولا وطلب من الأب والأم اختيار اسم آخر. وعندما رفض إدغور، طلب منه الموظف أن يذهب إلى عمالة تمارة للتحقق مما إذا كان يمكن تسجيل الاسم. وقالت العمالة إنها لن ترد، واقترحت عليه أن يقدم طلبه كتابة إلى مكتب الحالة المدنية. امتثل الوالدان، وثلاثة أيام بعد ذلك، تلقيا رداً إيجابيا. سجلوا اسم ابنتهما يوم 29 نوفمبر/تشرين الثاني.

    القانون الدولي يدعم حق الوالدين

    تنص الدورية D-3220 على أن الغرض من اشتراط "الطابع المغربي"، هو " الحفاظ على ھویتنا المغربیة وأصالتنا وتقالیدنا المبنیة على أسس راسخة".

    وقالت هيومن رايتس ووتش إن هذا الهدف لا يشكل مبررا كافيا لانتهاك حرية الآباء في تسمية أبنائهم كما يشاؤون، مشيرة إلى أن العديد من الأسماء المعترض عليها تشكل تعبيرا عن هوية الوالدين العرقية أو الثقافية.

    إن الحقوق المعترف بها دوليا للتعبير الفردي والثقافي، فضلا عن الحق في الخصوصية، وواجب الدول في احترام حقوق الأقليات، يربط سلطة الدولة في رفض الأسماء بظروف استثنائية ومحددة بدقة.

    وقضت لجنة الأمم لحقوق الإنسان في قضية كوريل وآخرون ضد هولندا سنة 1994:

    تنص المادة 17 [من العهد الدولي الخاص بالحقوق المدنية والسياسية]، من بين أمور أخرى، لا يجوز تعريض أي شخص، على نحو تعسفي أو غير قانوني، لتدخل في خصوصياته أو شؤون أسرته أو بيته أو مراسلاته. وترى اللجنة أن مفهوم الخصوصية يُحيل على دائرة حياة المرء التي يمكن فيها التعبير بحرية عن هويته أو هويتها... [هذا] يشمل الحماية من التدخل التعسفي أو غير القانوني في الحق في اختيار وتغيير المرء لاسمه الخاص.

    وينص قرار صادر عن نفس اللجنة عام 2010 في قضية "ريهمان ضد لاتفيا"، على أن فرض "اسم لاتفي النطق" على عضو من الأقلية اليهودية الروسية في هذا البلد يشكل انتهاكا للعهد. وعلاوة على ذلك، تنص المادة 27 من العهد الدولي الخاص بالحقوق المدنية والسياسية، " لا يجوز، في الدول التي توجد فيها أقليات اثنية أو دينية أو لغوية، أن يحرم الأشخاص المنتسبون إلى الأقليات المذكورة من حق التمتع بثقافتهم ...". هذا الحق بموجب المادة 27 يمتد إلى حرية الاختيار عند تسمية أبناء المرء بأسماء الأقليات.

    وقالت سارة ليا ويتسن: "ينبغي للمغرب إصلاح قانونه للحد بشكل صارم من دور الحكومة في مجال تقنين التسمية". وأضافت: "ما لم يكن الاسم مهينا أو يمكن الاعتراض عليه أو يضر بمصالح الطفل، فليس من مهمة السلطات كبح حق الآباء في اتخاذ هذا الخيار الشخصي للغاية

    اعتبر الصحفي المغربي والمدير السابق لأسبوعية "لو جورنال إيبدومادير"، أبو بكر الجامعي، في مقال نشر اليوم الخميس في جريدة "أبي ثي"، أن صمامات الأمان التي كان يعتمد عليها النظام المغربي بدأت تتلاشى "بفعل الضربات المتتالية للقصر الملكي"، داعيا الاتحاد الأوروبي إلى ممارسة ضغوط على المغرب لاستئناف مسلسل دمقرطة البلاد.

    وحذر أبو بكر الجامعي من تفاقم الغضب الشعبي بالمغرب، مؤكدا أن ثلاث عوامل تقوض فاعلية "صمامات الأمان" الاجتماعي التي مكنت من عدم حدوث انفجار اجتماعي ولخصها في إسكات الصحافة والتضييق على عمل جمعيات المجتمع المدني النزيهة مثل الجمعية المغربية لحقوق الإنسان وإنشاء حزب سياسي من قبل صديق الملك، فؤاد عالي الهمة.

    واعتبر الصحفي المغربي أن الثورة الشعبية في المغرب "ليست وشيكة" لأن نظام الملك محمد السادس "ما زال يتوفر على بعض صمامات الأمان تتمثل في وسطاء اجتماعيين يوجهون استياء المجتمع الذي يتوفر على مؤشرات نمو تعد من بين الأسوأ في العالم العربي". ولكنه اعتبر أن الجمود السياسي هو موضع مساءلة أكثر فأكثر من قبل الفاعلين السياسيين المحليين، الذين شجعهم ما حدث في مصر.

    وقال المدير السابق لأسبوعية "لو جورنال إيبدومادير" إن خلق حزب سياسي يسيره صديق الملك أدى إلى تهميش أكبر للأحزاب السياسية التقليدية والتي "تم أصلا تدجينها بشكل كبير".

    كما حذر من تأثير "مافيا الأعمال التي تحيط بالملك" والتي تغتني بشكل فاحش كما ذكرت الوثائق السرية للخارجية الأمريكية والتي تم تسريبها عبر موقع ويكيليكس. وأشار إلى أن القصر يسيطر على أكبر بنك في البلاد وعلى أكبر شركة تأمين وعلى واحدة من شركات الاتصالات الثلاث، وهو أكبر منتج زراعي، وناهيك عن عقارات عديدة.

    وأضاف أن استثمار القصر في عدة "كازينوهات" بالمغرب وخارجه "يقوض من صفته الملك كأمير للمؤمنين وهي إحدى ركائز شرعيته وسلاحه ضد الإسلاميين المتطرفين".

    "كل هذه الأخطاء، يضيف كاتب المقال، ينبغي أن تشجع الأطراف السياسية المحلية، ولكن أيضا الشركاء الدوليين وعلى رأسهم الاتحاد الأوروبي من أجل الضغط على النظام الملكي لاستئناف عملية التحول الديمقراطي التي تم تنويمها.
